Exemptions from Employer Paid Leave Requirements under the Families First Coronavirus Response Act

On April 3, 2020, TAUD issued TAUD COVID-19 UPDATE: Employer Paid Leave Requirements in the Families First Coronavirus Response Act. This April 3, 2020 Update described the emergency paid sick leave and expanded paid family and medical leave which state and local governments are required to give their employees beginning April 1, 2020.

The United States Department of Labor, Wage and Hours Division, (USDOL) adopted a temporary rule which became effective on April 2, 2020, in which it exercised the discretion given to it under the Families First Coronavirus Relief Act (FFCRA) to allow employers to exempt certain employees from the emergency paid sick leave and the expanded paid family and medical leave requirements in the FFCRA. Two of these exemptions are available to water, sewer and natural gas utilities operated by utility districts, utility authorities, and municipal and county water systems.
